TERMS & CONDITIONS

Please read these terms of use (‘Terms & Conditions’) carefully before using the Website (‘Site’). These Terms & Conditions constitute a legally binding agreement by and between Yogisattva and you. Your use of the Site constitutes your agreement with the Terms & Conditions and Yogisattva reserves the right to revise these Terms & Conditions at any time. You agree to check this section at regular intervals to be aware of any changes and the continued use of the Site shall be considered your agreement to any modified Terms & Conditions.

This Agreement ("Agreement") is an agreement between you and Yogisattva that states the Terms & Conditions under which you may use the Site and receive our service i.e. preparing and delivery throughout the day (“Meal Service”) of meals including but not limited to breakfast, lunch and dinner along with snacks, desserts and beverages and other items that Yogisattva may introduce from time to time (“Meals and Desserts”). It is also an agreement between you and Yogisattva under which you may use the Site and sign up for the Cooking classes and/or Culinary courses (“Classes”). Meal Service and Classes are hereinafter collectively referred to as (“the Services”). Your use of the Services and the Site constitutes your agreement with the Terms & Conditions set forth below.

Price and Availability - Yogisattva believes in offering the customers organic fresh Meals and Desserts at the convenience of their home. The price of the Meals and Desserts is subject to change without any notice. Although our goal is to fulfill the request of our customers and deliver the Meals and Desserts, given the perishable nature of the item, Meals and Desserts may be unavailable due to market conditions beyond our control.

Delivery of Meals and Desserts – We have outsourced our delivery to WeFast and their riders will be responsible for delivery of the Meals and Desserts. You will receive a confirmation message from our team and the delivery agent’s number at the time of delivery to coordinate the same from your end too. You can either choose to pay for delivery at the time of checkout (we charge a flat fee of Rs 350/-) or you can pay the rider the delivery fee in cash directly once he arrives. All our 24-hour pre-order items are available for next day delivery only. The rest is available for immediate delivery. To maintain the quality and integrity of the Meals, Yogisattva recommends that freshly prepared meals, dips and desserts be stored in the fridge. Savoury food should be consumed within the hour of arrival for maximum flavour. Desserts can be consumed over a period of 3 days to 1 month depending on what you order. In case of extreme weather or unforeseen delivery complications, it may be necessary to make adjustments in the delivery schedule, which will cause Yogisattva to make modification in the delivery time and dates. If there will be a significant delay, a representative from our team will contact or e-mail you to let you know the status of the delivery time. Yogisattva is not responsible for any sort of damage or delay in delivery. We completely rely on WeFast for delivery and you can go onto their website or app to read about their delivery terms & conditions. You can track the delivery on WeFast platforms directly. 

Cooking classes and Culinary courses- You can check the Classes Tab for the latest available options. Pick the workshop of your choice and add to cart. Once payment has been made, you will receive a payment receipt in your inbox as a confirmation. You can make the payment only through a debit/credit card on the Site.

Payment - You can make payment for your order through a debit/credit card on the Site. You will be charged for your order immediately upon checkout. Yogisattva will not process orders that attempt to use an incorrect, expired or over the limit credit card. Yogisattva will make best efforts to contact you if this occurs. Yogisattva has the right to collect funds from any uncollected transactions owed to it. Yogisattva may charge an appropriate fee in INR (Indian Rupees) per order, should a payment made via credit card decline. If you fail to pay any fees or charges when due or if a re-delivery fee is imposed, Yogisattva may charge such amount directly to recover such fee. You shall be responsible and liable for any fees, including but not limited to lawyer fees and collection costs, that Yogisattva may incur in its efforts to collect any unpaid balances from you. 

Personal Information - The online registration requires users to give their personal information like your name, e-mail address, contact number, home address or office address. As a user of the Site, you are required to submit a valid e-mail address and choose a username representing your identity on the Site.

Use of your Personal Information - We will utilize your email address, phone number to notify you of updates and changes in the menu and/or functioning of the Site. Your contact information is also used to contact you whenever necessary. We use your IP address to help diagnose problems with our server, and to administer the Site. Your IP address is also used to help identify you and to gather broad demographic information. Finally, we may use your IP address to help protect Yogisattva from fraud. Yogisattva will continue to enhance the security procedures as new technology becomes available. We may release your personal information to a third-party in order to comply with a Court Order or other similar legal procedure, or when we believe in good faith that such disclosure is necessary to comply with the law; prevent imminent physical harm or financial loss; or investigate or take action regarding illegal activities, suspected fraud, or violations of the Terms & Conditions. Yogisattva may disclose personally identifiable information to parties as Yogisattva in their sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, Yogisattva may disclose name, address, country, phone number, email address and company name.

Our disclosure of your Personal Information - Due to the existing regulatory environment, Yogisattva cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting and foregoing), Yogisattva may be forced to disclose information to the Government, law enforcement agencies or third parties. Under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or members may abuse or misuse your information that they collect from Yogisattva Site. Therefore, although Yogisattva uses industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personally identifiable information or private communications would always remain private. As a matter of policy, Yogisattva does not sell or rent any personally identifiable information about you to any third party.

Further, there may be a number of services offered by external service providers that help you use the Site. If you choose to use these services offered by external service providers, and in the course of doing so, disclose information to such external service providers, and grant them permission to collect information about you, then the use of your information is governed by their privacy policy.

Cancellation and Refund Policy for Meal Service – Once order has been placed on the Site, Yogisattva does not process any cancellation towards any orders. In case you were not happy with the Service and the Meals and Desserts let us know at [email protected]. We have a no refund policy so please only place orders once you are absolutely sure of what you want. 

For Live Cooking Classes: In case you can’t make it due to any personal emergency, you will need to inform Yogisattva 24 hours prior/post the class. In that case, Yogisattva will offer you the option of attending the same class with the same menu whenever it is repeated again with Rs 500/- taken off your total bill value. This offer has to be redeemed within a 6-month period for it to stay valid. No request post the mentioned time frame will be considered.

For Culinary Courses: If you are unable to finish the course within the time frame, no extension will be provided. 

Third Party Rights - Nothing in these Terms & Conditions shall confer any rights upon any third party. The agreement created by these Terms & Conditions is between you and Yogisattva.

Proprietary Rights - All materials on the Site, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (collectively, “Material”) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Yogisattva. You acknowledge and agree that all Material on the Site is made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere in the Site, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without express written permission of Yogisattva. You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or any part of the Material for any purpose other than its intended purposes is strictly prohibited. The Site may not be used in connection with any commercial purposes, except as specifically approved by Yogisattva.

Confidentiality - You further acknowledge that the Site may contain information which is designated confidential by Yogisattva and that you shall not disclose such information without our prior written consent. Your information is regarded as confidential and therefore will not be divulged to any third party, unless if legally required to do so to the appropriate authorities. Yogisattva will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Yogisattva will only be in connection with the provision of agreed Services.

Security - Yogisattva treats data as an asset that must be protected against loss and unauthorized access. Yogisattva employs many different security techniques to protect such data from unauthorized access by members inside and outside the company. Yogisattva does not recommend transfer of sensitive information (such as credit card number) and bank account details via the site to any third party. Users are recommended to do so offline, on the phone or via personal emails. Yogisattva follows accepted industry standards to protect the personal information submitted to us, both during transmission and once Yogisattva receives it. However, "perfect security" does not exist on the Internet. You therefore agree that any security breaches beyond the control of our standard security procedures are at your sole risk and discretion.

Prohibited Use- In addition to other prohibitions as set forth in the Terms & Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related Website/App, other Website/Apps, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the service or any related website/app, other website/apps, or the Internet. We reserve the right to terminate your use of the service or any related website/app for violating any of the prohibited uses.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY- We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without prior notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall we, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Communications - All notices/communications shall be given to Yogisattva either by post to the address: 7th Floor Pinnacle House, 15th Road, Bandra, Citywalk Shoes Lane, Mumbai: 400050or by email to [email protected]. Such notice will be deemed received 4 (four) days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

Indemnification- You agree to indemnify, defend and hold harmless Us and Our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability - In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

Governing Law - These Terms and Conditions and the relationship between you and Yogisattva shall be governed by and construed in accordance with all the applicable laws of the state of Maharashtra and agree to submit to the exclusive jurisdiction of the Courts of Mumbai.
